Pit Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Pit mobile application (the "App"), operated by The Pit App LLC ("Pit," "we," "us"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use Pit. Pit is not available in all jurisdictions, and availability of certain features is determined by your approximate location. You are solely responsible for determining whether your use of Pit is lawful in your jurisdiction.

2. What this version of the App provides

This version of Pit is a social and market-data application. It allows you to create an account, follow other users, post and read content, send direct messages, view live cryptocurrency market data, and maintain a watchlist.

Buying, selling, position management, deposits, and withdrawals are not offered in this version of the App. Pit does not execute any transaction on your behalf in this version, and does not place, route, or submit any order.

3. Your wallet

When you create an account, an embedded cryptocurrency wallet is created for you on two networks by our infrastructure partner, Privy. This happens whether or not you use any feature that needs it, and the App does not display the wallet's address to you in this version.

Pit does not custody your funds. The underlying key material is managed by Privy's infrastructure. Pit's backend systems hold no funds and no private keys on your behalf. You are responsible for your account security, including your device's authentication and the sign-in method linked to your Privy account.

Your public wallet address is associated with your public profile and is visible to other signed-in users. Public blockchain addresses and their transaction history are permanent, public, and outside our control.

4. Market data and content are not advice

The App displays market data, user posts, trade calls, leaderboards, and performance figures. None of it is financial, investment, or trading advice, and none of it is a recommendation to buy, sell, or hold any asset. Cryptocurrency markets are highly volatile and operate continuously without the circuit breakers or investor protections of regulated markets.

Market data is sourced from third-party venues and public blockchain networks. We do not control those sources and do not warrant that any price, statistic, or market listing is accurate, complete, or current.

5. Trade calls are unverified user statements

Users can post trade calls — claims about a market direction, entry price, leverage, and profit or loss. In this version of the App, those figures are typed in by the user who posts them. Pit does not verify them against blockchain records or any other source before publishing them, and makes no representation that any trade call describes a real position or a real result.

Treat every performance figure attributed to another user as an unverified claim by that user. Do not rely on it.

By posting a trade call you confirm that the information in it is accurate to the best of your knowledge, and you acknowledge that posting one causes Pit to begin monitoring the public blockchain activity of the wallet address associated with your account so that the claim can be evaluated against public records.

6. User-generated content

You are solely responsible for content you post, including trade calls, posts, replies, direct messages, and profile information. By posting, you grant Pit a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content within the App as necessary to operate the service.

You must not submit, post, or transmit content that is unlawful, obscene or sexually explicit, harassing, threatening, hateful or discriminatory, defamatory, deceptive or fraudulent, market-manipulative, impersonates another person or entity, infringes another person's rights, contains malicious code or spam, or discloses another person's private information. You must not post trading claims you know to be false, or abuse, harass, or threaten other users.

There is no tolerance for objectionable content or abusive users. You can report content or users from within the App, and you can block or mute other users. We review reports and will remove offending content and suspend or ban the accounts responsible within 24 hours of a report. You may report abuse directly to us at support@thepitapp.xyz. If you believe an enforcement decision was made in error, you may appeal it through the same address. What is and is not allowed on Pit is set out in our Community Guidelines, which form part of these Terms.

7. Account suspension, termination, and deletion

We may suspend or terminate your account for violations of these Terms, suspected fraud or market manipulation, or as required by law.

You may delete your account at any time from Settings → Legal & Privacy → Delete Account (a suspension does not prevent you from deleting your account), or by request at https://thepitapp.xyz/account-deletion. Deletion takes effect immediately — your account is deactivated and hidden — and becomes permanent after a 7-day grace period, with the exact date disclosed to you when you request it. During the grace period you may cancel by signing back in and choosing Restore account; if your account was suspended when you requested deletion, restoring it returns you to that still-active suspension, not to good standing.

After the grace period your data is deleted or anonymized as described in our Privacy Policy under "Data retention and deletion," and signing up again creates a new account with no prior history. Deleting your Pit account does not affect the underlying wallet or any blockchain record associated with it, which exist independently of Pit on public infrastructure we do not control.

8. Third-party services

Pit depends on third-party services to work. Your use of them is also governed by their own terms and privacy policies, which we encourage you to review:

We do not control these services and are not responsible for their acts, omissions, outages, or changes to their own terms. We do not integrate a fiat payment or card processor in this version of the App. What data each service receives is described in our Privacy Policy.

9. Availability and changes to the service

Features may be added, removed, or changed, and availability may differ by region and over time. The absence of a feature in this version of the App is not a commitment that it will remain absent, and its presence is not a commitment that it will remain available. Material changes to what the App offers will be reflected in these Terms and in our Privacy Policy.

10. Disclaimers and limitation of liability

The App is provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, Pit disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage. We do not warrant that the App will be uninterrupted, timely, secure, or error-free, or that any market data, price, statistic, performance figure, or notification will be accurate, complete, or delivered on time.

In particular, and without limiting the above, Pit is not liable for:

To the fullest extent permitted by law, Pit will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any trading losses, lost profits, lost opportunity, loss of data, or loss of goodwill, even if we were advised such damages were possible.

Pit's total aggregate liability for all claims relating to the App is limited to the greater of (a) the total amount you paid Pit in the twelve months before the event giving rise to the claim, or (b) US $100.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, or under mandatory consumer-protection law in your country of residence.

11. Dispute resolution

Talk to us first. If you have a dispute, email support@thepitapp.xyz with a description of the problem and the relief you want. Both of us agree to try to resolve it informally for 30 days before starting a formal proceeding.

Governing law. These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. If you are a consumer, this does not deprive you of the protection of the mandatory laws of your country of residence.

Binding arbitration and class-action waiver. If we cannot resolve a dispute informally, it will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Delaware and, where the rules allow, conducted remotely or on written submissions. You and Pit each waive the right to a jury trial and to participate in a class, collective, or representative action; an arbitrator may award relief only to the individual party seeking it.

Your right to opt out. You may reject the arbitration and class-waiver terms above by emailing support@thepitapp.xyz within 30 days of first accepting these Terms, stating your account handle and that you opt out. Opting out does not affect any other part of these Terms.

Exceptions. Either party may bring a claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual property or stop unauthorized access to the App. Consumers resident in the European Union, the United Kingdom, or any other jurisdiction where a pre-dispute arbitration agreement or class waiver is unenforceable are not bound by the arbitration and class-waiver terms and may bring proceedings in their local courts.

Time limit. Any claim relating to the App must be brought within one year after it arises, except where a longer period is required by law.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of the App after a change constitutes acceptance of the updated Terms.
